These Terms of Service ("Terms") govern your access to and use of Whittle, the expense-tracking application, and related websites (the "Service"), operated by The Bearded Coder LLC ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Agreement & eligibility

You must be at least 18 years old to use the Service. If you use the Service on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms, and "you" refers to both you and that entity.

2. The Service

The Service lets you track expenses, income, budgets, and mileage, see an estimated net profit for each year, upload receipts, import bank or card transactions, receive budget alerts, search your expense history, generate spending reports (for a full year or a quarter), check a period for missing records (a substantiation check), print audit binders that pair each expense with its receipt, export your records for tax time (including Schedule C summaries and common accounting and tax-software formats), export your data, and (on eligible plans) collaborate with team members under a shared account, including expense approval and reimbursement workflows and tracking the reimbursements owed. Some features use artificial intelligence (including receipt scanning, automatic categorization, quick-add from a typed or dictated description, the "ask your expenses" assistant, monthly insights, and the Snapshot takeaway) to help with data entry and analysis; some of them run automatically on eligible plans, as described in our Privacy Policy. Plans include usage limits, such as AI usage quotas, receipt storage caps, expense and income history limits, and fair-use limits, which vary by plan and are shown on the pricing page.

Drives are valued at the IRS standard mileage rate in force on each drive's date, and we record the rate used. A drive's amount can be recalculated automatically: when a rate is added for a period whose drives were valued at an earlier rate (for example, January drives logged before that year's rate was published, or drives after a mid-year change that was entered late), when we correct a rate that was entered incorrectly, or when you edit a drive recorded before rates were tracked per drive. A budget entry already linked to a recalculated drive is updated to match. Drives already marked reimbursed are never recalculated, and editing a drive without changing its date keeps the rate it was valued at.

Our website also offers free tools that anyone can use without an account: a self-employed tax estimator, a mileage deduction calculator, and a page of quarterly estimated tax due dates. If you ask a tool to email your results, we send you that one email; how we handle the email address you enter is described in our Privacy Policy.

We may improve, change, add, or discontinue features over time. For changes that materially reduce core functionality, we will provide reasonable advance notice where practical. We may also take the Service offline for maintenance; for planned extended downtime we will give reasonable advance notice, though emergency or unplanned maintenance may occur without notice.

3. Accounts & security

You are responsible for safeguarding your login credentials and for all activity under your account. You must provide accurate, current information and keep it up to date, and you must verify your email address to use core features of the Service. 4. Subscriptions, trials & billing

New accounts include a 14-day free trial, no credit card required. After the trial, continued access to paid features requires a subscription to one of our plans (currently Starter, Pro, and Team; the Team plan is billed per active member/seat). Plans may be offered with a monthly or an annual billing interval; whichever you choose, paid plans are billed in advance for the full billing period on a recurring basis through our payment processor, Stripe, and renew automatically until cancelled; an annual plan renews for a further year at the end of each paid year. You authorize us and Stripe to charge your payment method for each renewal. If you switch plans or billing intervals mid-period, the change takes effect immediately and Stripe prorates the difference against what you have already paid.

When a trial ends without a subscription, and whenever a paid subscription lapses, the account moves to our Free plan rather than closing. We never delete your data on downgrade. On the Free plan your expenses stay readable and editable, and you may add up to 25 new expenses per calendar month, up to a total of 300 saved expenses, with up to 250 MB of receipt storage. Once that history limit is reached you can still view, edit, and delete everything you have logged, but adding more requires upgrading or deleting expenses you no longer need; we never delete or hide your expenses for you. The income log is on every plan and holds up to 300 entries on the Free plan, under the same rules: you can always view, edit, and delete the entries you logged, and once that limit is reached, adding more requires upgrading or deleting entries you no longer need. Budgeting, reports, CSV and tax export, bank/CSV import, the reimbursement approval workflow, and all AI features are reserved for paid plans, and some paid features are available only on higher tiers, as shown on the pricing page. Data from those features (such as budgets, imported transactions and drafts, and AI insights) is kept while you are on the Free plan, is included in your data export, and is available again when you upgrade. Free accounts cannot send new team invitations, and invitations already sent from a Free account can't be accepted until it upgrades, though existing members of an account keep their access. The Free plan is offered as-is: we may change its limits or discontinue it on reasonable notice, and it carries no availability or support commitment.

You can cancel at any time from your billing portal; your access continues until the end of the current billing period (for annual plans, until the end of the paid-up year). Fees are non-refundable except where required by law. Prices are exclusive of taxes, which you are responsible for where applicable. We may change our prices on a going-forward basis; we will give you at least 30 days' notice before any price increase, and the new price applies at your next renewal after the notice period. If a payment fails, your access to paid features may be suspended, and the account operates under Free plan limits, until the balance is resolved.

5. Acceptable use

You agree not to: use the Service for any unlawful purpose; attempt to access data or accounts that are not yours; interfere with, overload, or disrupt the Service; probe or breach its security; reverse engineer, copy, or resell the Service; or upload malicious code. We may suspend or terminate accounts that violate these rules.

6. Your content & data

You retain ownership of the content and data you upload or import. You grant us a limited license to host, store, process, and transmit your content solely as needed to provide and support the Service, including processing by our AI provider when AI features run for your account (see our Privacy Policy). You are responsible for your content, for having the rights to upload or import it, and for the legality of any third-party personal information you enter (and for providing any notices or obtaining any consents that law requires). You can download a full copy of your data at any time, on any plan: a ZIP archive with your records (in JSON) and your receipt files, covering the accounts you own. Paid plans also offer CSV and tax-software exports. You can delete your data at any time.

7. Our intellectual property

The Service, including its software, design, and the Whittle and The Bearded Coder names and branding, is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms; no other rights are granted.

8. Third-party services

The Service relies on third-party providers (such as Stripe for payments). Your use of those services through the Service may also be subject to their own terms, and we are not responsible for their acts or omissions.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, and it is not a substitute for professional tax, accounting, or legal advice.

Some features use artificial intelligence, and AI-generated output (such as data extracted from receipts, suggested categories, categories applied to imported transactions and budget entries, expense details, business purposes, and notes written from a typed or dictated description, assistant answers, and insights, anomalies, suggestions, or forecasts) may be inaccurate or incomplete. It is provided to assist you, not to replace your judgment, and is not professional tax, accounting, or financial advice. You are responsible for reviewing and confirming AI output before relying on it.

Reports, Schedule C summaries and line assignments, deductibility labels, tax-software (.TXF) files, mileage valuations, substantiation checks, and audit binders organize the records you enter. They do not decide how any item should be treated on your tax return, and we do not guarantee that a tax authority or tax software will accept them. A substantiation check with nothing flagged means only that the common gaps it looks for were not found; it is not a determination that your records meet any tax authority's requirements. The receipt fingerprints (SHA-256) in an audit binder are computed from the files as stored when the binder is generated.

Net profit figures subtract the expenses your Schedule C summary counts from the income you record. They are estimates, not your taxable income.

The free tools give general estimates and dates for planning, not tax advice. They use the figures you enter and the IRS rates, rules, and dates as we understand them, cover federal tax only, and cannot account for your full tax situation. Due dates marked as projected are worked out from the IRS rule until the IRS publishes them, and the IRS can move a due date, for everyone or only for people in a disaster area, in ways the page may not show. Check amounts and dates with the IRS or a tax professional before you rely on them.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless The Bearded Coder LLC from any claims, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

12. Suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends; you may export your data for a short period beforehand where practical, after which it is deleted or de-identified as described in our Privacy Policy.

13. Governing law & disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You and we agree to first try to resolve any dispute informally by contacting thebeardedcoderco@gmail.com. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. We will post the revised version here with a new "Last updated" date and, for material changes, notify you by email or in-app. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

15. Miscellaneous

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control. We will send notices to the email on your account; you can reach us at the address below.
