Terms of Service

These Terms of Service ("Terms") govern your access to and use of Whittle, the expense-tracking application, and related websites (the "Service"), operated by The Bearded Coder LLC ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Agreement & eligibility
You must be at least 18 years old to use the Service. If you use the Service on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms, and "you" refers to both you and that entity.
2. The Service
The Service lets you track expenses, budgets, and mileage, upload receipts, import bank or card transactions, receive budget alerts, generate spending reports and tax-time exports (including common accounting formats), export your data, and (on eligible plans) collaborate with team members under a shared account, including expense approval and reimbursement workflows. Some features use artificial intelligence (including receipt scanning, automatic categorization, the "ask your expenses" assistant, and monthly insights) to help with data entry and analysis. Plans include usage limits, such as AI usage quotas, receipt storage caps, and fair-use limits, which vary by plan. We may improve, change, add, or discontinue features over time. For changes that materially reduce core functionality, we will provide reasonable advance notice where practical. We may also take the Service offline for maintenance; for planned extended downtime we will give reasonable advance notice, though emergency or unplanned maintenance may occur without notice.
3. Accounts & security
You are responsible for safeguarding your login credentials and for all activity under your account. You must provide accurate, current information and keep it up to date, and you must verify your email address to use core features of the Service. Notify us promptly at thebeardedcoderco@gmail.com if you suspect any unauthorized use of your account.
4. Subscriptions, trials & billing
New accounts include a 14-day free trial, no credit card required. After the trial, continued access to paid features requires a subscription to one of our plans (currently Starter, Pro, and Team; the Team plan is billed per active member/seat). Paid plans are billed in advance on a recurring basis through our payment processor, Stripe, and renew automatically until cancelled. You authorize us and Stripe to charge your payment method for each renewal.
You can cancel at any time from your billing portal; your access continues until the end of the current billing period. Fees are non-refundable except where required by law. Prices are exclusive of taxes, which you are responsible for where applicable. We may change our prices on a going-forward basis; we will give you at least 30 days' notice before any price increase, and the new price applies at your next renewal after the notice period. If a payment fails, your access to paid features may be suspended until the balance is resolved.
5. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to access data or accounts that are not yours; interfere with, overload, or disrupt the Service; probe or breach its security; reverse engineer, copy, or resell the Service; or upload malicious code. We may suspend or terminate accounts that violate these rules.
6. Your content & data
You retain ownership of the content and data you upload or import. You grant us a limited license to host, store, process, and transmit your content solely as needed to provide and support the Service, including processing by our AI provider when you use AI features (see our Privacy Policy). You are responsible for your content, for having the rights to upload or import it, and for the legality of any third-party personal information you enter (and for providing any notices or obtaining any consents that law requires). You can export your data (for example, a CSV of expenses or a full JSON copy of your account) or delete it at any time.
7. Our intellectual property
The Service, including its software, design, and The Bearded Coder name and branding, is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms; no other rights are granted.
8. Third-party services
The Service relies on third-party providers (such as Stripe for payments). Your use of those services through the Service may also be subject to their own terms, and we are not responsible for their acts or omissions.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, and it is not a substitute for professional tax, accounting, or legal advice.
Some features use artificial intelligence, and AI-generated output (such as data extracted from receipts, suggested categories, assistant answers, and insights or forecasts) may be inaccurate or incomplete. It is provided to assist you, not to replace your judgment, and is not professional tax, accounting, or financial advice. You are responsible for reviewing and confirming AI output before relying on it.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless The Bearded Coder LLC from any claims, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.
12. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends; you may export your data for a short period beforehand where practical, after which it is deleted as described in our Privacy Policy.
13. Governing law & disputes
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You and we agree to first try to resolve any dispute informally by contacting thebeardedcoderco@gmail.com. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. We will post the revised version here with a new "Last updated" date and, for material changes, notify you by email or in-app. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
15. Miscellaneous
These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control. We will send notices to the email on your account; you can reach us at the address below.
